Terms and conditions

1. Purpose

The provider is Lauris Mesnil, sole trader, French business number 108 849 126, trading as Sitecléo. These terms cover the building of a website by Sitecléo and, where taken, the monthly plan that goes with it. They sit alongside the proposal sent to the client, which prevails where the two differ.

2. Price

Building the site: €490. Optional monthly plan: €90/mo, or €190/mo with automations and the dashboard. Prices are in euros and net of tax: the provider is under the French VAT exemption scheme (article 293 B of the French tax code), so no VAT is added. The contract is with Lauris Mesnil, sole trader registered in France, who is the only invoicing entity: Sitecléo does not contract through any entity established outside France.

3. What the build covers

A custom-built site, with motion matched to the client’s trade, copy written for their business, comfortable reading on a phone, and launch after approval. The site goes live within 3 to 5 days of Sitecléo receiving all the information and content needed. The package covers up to four pages and two rounds of revisions. The clock starts once Sitecléo has received all of the following: the copy, or the information needed to write it; the photographs; the logo, if one exists; the contact details and opening hours; the list of services. Pages beyond the fourth and further revisions are quoted separately.

4. What the monthly plan covers

Hosting, the domain name, security updates, backups and routine changes. The higher plan adds request routing, a dashboard and the automations agreed with the client. The plan has no minimum term. Either party may end it at any time with thirty days’ notice; the subscription stops at the end of the current period, with nothing further to pay. The volume of changes included and the response time are set out in the proposal sent to the client.

5. Orders

Sending the form records a contact request. It is not an order, not a booking and not a commitment either way. An order exists once a proposal is accepted in writing. Payment is made through a secure payment link sent by the provider. The build price of €490 is paid in full when the order is placed. There are no instalments.

6. Client obligations

The client supplies the information and content needed. They warrant that they hold the rights to the text, photographs, logos and trademarks they send, and remain responsible for the accuracy of what is published on their site.

7. Ownership and usage rights

The delivered site becomes the client’s property as soon as the build price has been paid in full. The files and content remain theirs, including if they end the monthly plan: Sitecléo keeps no right to take the site back and does not lock or switch off a site that has been paid for. Where the domain name is covered by the plan, it is transferred to the client on request. Sitecléo keeps ownership of its own tools, templates and reusable components, and the right to show the work as a reference, unless the client objects in writing.

8. Results

Sitecléo does not guarantee traffic, a number of enquiries, or a position in search results. The site presents the client’s business and makes contact easier; results depend on their offer, their market and their visibility.

9. Liability

Sitecléo applies reasonable care to keep the site working. Outages caused by the host, the domain registrar or a third-party service fall outside its responsibility. Sitecléo’s liability, on any ground, is limited to the amount actually paid by the client for the service concerned — at most €490 for the build.

11. Governing law

These terms are governed by French law. The contract is between businesses, the client acting for the purposes of their trade, so consumer mediation rules do not apply. Failing an amicable settlement, the French courts have jurisdiction.
